    • all customers worldwide

    • ceremonial cacao and food products
    • natural products
    • handmade items (e.g. bracelets)
    • third-party products (e.g. incense), where we act as an official distributor

    7. Product Nature

    Products may be:

    • food products (subject to food regulations)
    • non-food lifestyle or handcrafted products

    8. Natural products may vary in:

    • color
    • texture
    • taste
    • appearance

    9. Such variations do not constitute defects.

    4. Prices & Currency

    • Prices may be displayed in different currencies (EUR, USD, DOP or other local currencies)
    • Currency display may depend on user location, system settings, or payment provider

    10. The final and binding price is:

    • shown at checkout
    • confirmed on the invoice

    11. Prices may include or exclude VAT depending on:

    • customer location
    • applicable tax rules
    • seller entity

    12. 5. Payment

    Accepted payment methods are displayed at checkout and may include:

    • bank transfers (via Bank Pekao S.A. or other institutions)

    13. Payments are processed via external providers. The seller does not store sensitive payment data.

    6. Order & Contract Formation

    2. The order constitutes a binding offer
    3. The contract is concluded upon order confirmation (email or system confirmation)

    14. The seller reserves the right to reject orders in justified cases (e.g. pricing errors, suspected fraud, product unavailability).

    7. Customer Obligations

    Customers must:

    • provide accurate and complete information
    • ensure proper storage and handling of products
    • comply with applicable laws in their country

    15. 8. Shipping & Delivery

    We ship worldwide.

    Processing

    Orders are typically processed within 1–3 business days after payment confirmation.

    Estimated Delivery Times (Non-Binding)

    • European Union: approx. 2–6 business days
    • International shipments: may take longer depending on destination

    16. These delivery times are indicative only and may vary depending on:

    • customs procedures
    • logistics providers
    • external factors beyond our control

    17. The final delivery conditions and shipping costs are:

    18. Customs, Duties & Import Taxes

    For orders shipped outside the European Union:

    • The customer is solely responsible for customs duties, import taxes, and any additional fees
    • These charges are not included in the product price or shipping cost
    • The customer is responsible for compliance with local import laws

    19. Failure to pay customs duties or accept delivery may result in:

    • return or destruction of the shipment
    • additional costs, which may be charged to the customer

    20. Risk Transfer

    Risk transfers to the customer upon delivery of the goods.

    9. Right of Withdrawal (EU Consumers)

    If the seller is an EU-based entity (e.g. Fundacja Almarte), consumers have the right to withdraw within 14 days of receiving the goods.

    10. Exceptions (Food Products)

    The right of withdrawal does not apply to:

    • perishable goods
    • opened food products
    • goods unsuitable for return due to hygiene reasons
    • products that have been improperly stored

    21. This applies in particular to cacao and similar products.

    11. Returns & Refunds

    Returns are accepted only if:

    • products are unopened
    • in original condition
    • properly stored

    22. Return process:

    1. Contact us within 14 days
    2. Wait for return instructions
    3. Return goods securely

    23. Return shipping costs are borne by the customer unless otherwise required by law.

    Refunds are processed after inspection.

    12. Defective or Damaged Goods

    If goods are defective or damaged:

    • notify us within 48 hours
    • provide photographic evidence

    24. We will provide replacement or refund in accordance with applicable law.

    13. Liability

    We are liable in accordance with applicable law.

    We are not liable for:

    • improper storage or use after delivery
    • delays caused by third parties or force majeure
    • indirect or consequential damages, unless legally required

    25. 14. Availability

    Products are subject to availability.

    We reserve the right to:

    • modify or discontinue products
    • adjust pricing

    All content on this website is protected by intellectual property rights.

    Unauthorized use is prohibited.

    16. Applicable Law

    The applicable law depends on the seller:

    • If the seller is Fundacja Almarte (Poland) → Polish law applies
    • If the seller is Almarte SRL (Dominican Republic) → Dominican law applies

    27. The applicable law is determined by the entity stated on the invoice.

    Mandatory consumer protection rights remain unaffected.
